Legal Update: Registration of Private Parts of Co-owned Buildings

A Prakas on Rules and Procedures on Registration of Private Parts of Co-owned Buildings ("Prakas") was released on July 19, 2024 by the Ministry of Land Management, Urban Planning and Construction (MLMUPC). The main effect of this Prakas is to establish a legal framework for the registration of each co-owner's legal ownership rights for properties built prior to December 19, 1997.

Scope

This Prakas applies to all co-owned buildings that were built before 19 December 1997.

Registration requirements

Application Documents: The application form must be completed in Khmer, and the local authorities' certification of the supporting documentation is not necessary.

Individual: Right-thumb fingerprint or signature directly on the registration form by the applicant.

Sole proprietorship:

  1. Right-thumb fingerprint or signature;
  2. Full name of the legal representative; and

iii. Enterprise's official stamp;

Partnership and company

  1. Signature or fingerprint using the right thumb;
  2. The legal representative's full name;

iii. The official stamp of the enterprise; and

  1. A power of attorney from the board of directors or shareholders, as defined by the articles of organization and memorandum, must also be included.

Other Legal Entities

  1. Signature or fingerprint from the right thumb,
  2. The representative's full name,

iii. The official stamp of Enterprise.

  1. A power of attorney from the legal entity's designated decision-maker needs to be included.
